Mark Levin is proposing ten amendments to the Constitution. Each one is written in thoughtful language so as to preclude any ancillary problems:

1) Term Limits: He proposes limiting service in both the House and Senate to 12 years. Yes, we’ve heard all the arguments about elections being the best limit. But the past 100 year has proven that to be false. As someone who works day and night to throw the bums out, I can tell you that is nearly impossible to throw them out with the amount of money they raise – precisely for their abuses of power. Levin also proves that limiting time in office was a highly regarded proposal during the Constitutional Congress.

2) Repealing the 17th Amendment: Levin proposes repealing the 17th amendment and vesting state legislators with the power to elect senators so that the power of states is not diluted, as originally feared by the framers of the Constitution.

3) Restoring the Judiciary to its proper role: The Judiciary was never meant to be an all-powerful institution in which five men in robes have the final say over every major policy battle in the country. In order to end judicial tyranny, Levin proposes limiting service to one 12-year term, and granting both Congress and the state legislatures the authority to overturn court decisions with the vote of three-fifths of both houses of Congress or state legislative bodies.

4) Limiting Taxation and Spending: Levin proposes a balanced budget amendment, limiting spending to 17.5% of GDP and requiring a three-fifths vote to raise the debt ceiling. He also proposes limiting the power to tax to 15% of an individual’s income, prohibiting other forms of taxation, and placing the deadline to file one’s taxes one day before the next federal election.

5) Limiting bureaucracy: He proposes an amendment to limit and sunset federal regulations and subject the existence of all federal departments to stand-alone reauthorization bills every three years.

6) Defining the Commerce Clause: Levin writes an amendment that, while technically unnecessary, is practically an imperative to restoring the original intent of the Commerce Clause. The amendment would make it clear that the commerce clause grants not power to actively regulate and control activity; rather to prevent states from impeding commerce among other states, as Madison originally intended.

7) Limiting Federal power to take private property (restoring the takings clause and burying the eminent domain).

8) Allowing State Legislature to Amend the Constitution: Although the Framers intentionally made it difficult to amend the Constitution, they did so to preserve the Republic they created. However, the progressives have illegally altered our Republic through a silent and gradual coup without using the amendment process. If we are going to successfully push the aforementioned amendments, we will need an easier mechanism to force them through. The proposed amendment allows states to bypass Congress and propose an amendment with support of just two-thirds of the states (instead of three-fourths) and without convening a convention.

9) State Authority to Override Congress: A proposed amendment to allow states to override federal statutes by majority vote in two-thirds of state legislatures. The last two proposals are rooted in the idea that the states only agreed to the Constitution on condition that their power would not be diluted and that all federal power is derived from the states.

10) Protecting the Vote: A proposal to require photo ID for all federal elections and limit early voting.

Taken as a whole, there is no doubt that these amendments would restore our Republican form of government. Every proposal is backed up by scholarly analysis of the Framers’ view on the proposal, an overview of what has changed since the founding, and the rationale for why the proposal is necessary.

Lets start with number 10 - in red states we know that many of those who vote for the liberal candidate do not have id and they often vote early. Limiting early voting will in fact push the elderly, low income, the handicapped away from voting at all.

On number 6, yes and that's a good thing. I would like CONGRESS to make laws. Not some federal bureaucrazy of paper pushers that can never be voted out, even though they do great damage to the country. Madison was not a Republican BTW.

The book, which offers ten constitutional amendments, evokes a certain idealism that would be endearing if the consequences to the lives of millions weren't so horrific. Levin's proposals, of course, set the conservative media's heart aflutter.

Rush Limbaugh gave the book a ringing endorsement, saying on his radio program: "The Constitution's bastardized. It's been bastardized for years. It's been shredded for years. It needs to be reaffirmed. And Levin's book is a series of ideas of how to do it that involves the American people."

Levin isn't just another radio host, as Republican National Committee chair Reince Priebus recently said he was receptive to the idea of Levin and Sean Hannity moderating a 2016 Republican presidential primary debate.

In The Liberty Amendments, Levin lays out a conservative dystopian nightmare. Among the most toxic of his ideas would be the redefinition of the Commerce Clause to wipe out nearly all the hard fought protections of the 20th century. By arguing that the federal government's powers under Article 1, Section 8 have been unjustly expanded by the Supreme Court, Levin implicitly acknowledges this debate is over. Instead of accepting this, Levin seeks to alter the clause by limiting the definition of interstate commerce explicitly to "preventing states from impeding commerce and trade between and among the several States."

The results would be disastrous with nearly every legislative achievement since the New Deal wiped out. The Fair Labor Standard Act that established a minimum wage and outlawed child labor would be a thing of the past.

But Mark Levin's proposal to overturn decades of Supreme Court precedent in order to radically redefine the Commerce Clause is not only an assault on the fair labor laws of the New Deal, it would also endanger seminal civil rights laws and national law enforcement authority. http://mediamatters.org/blog/2013/08/19/mark-levins-electoral-kryptonite/195471

The Free Democracy Amendments

1. Barring violation to the rights of others, the right of a free people to be secure in their individual decisions of personal safety, ingestion, expression, activity, association, and property, shall not be violated without due process of law.

2. The freedom from direct taxation being necessary for the right of a free people to be sovereign in the ownership of their labor and of their property, the imposition of direct taxation shall be prohibited at all levels of government allowing for only indirect taxation with tax deductions for non-patrons of social welfare services.

3. Neither slavery nor involuntary servitude shall exist within the United States or any place subject to their jurisdiction.

4. Barring conviction for either treason or for voting fraud, the right of all mentally coherent adult citizens to vote at all levels of government shall be guaranteed, the violation of which shall be punishable with equivalence to an act of treason.

5. The right of a politically free and democratic people to engage in Initiative, Referendum, and Recall, to have all of their votes counted, and to be without the undemocratic imposition of an electoral college, shall be guaranteed at all levels of government.

6. The provision of Patriot Dollars to voters for the sole funding of political campaigns at all levels of government shall be enacted to keep political campaigns free from the undemocratic influences of monied interests that shall be prohibited from funding any political advertisements outside of political campaigns.

7. The offering or acceptance of any item or service of value including but not limited to the offering or acceptance of future employment involving a public official or candidate for public office of any branch or level of government shall be prohibited and punishable with equivalence to an act of treason.

8. All communication to take place between a lobbyist and a public official shall be public and open to the press, the violation of which shall be punishable with equivalence to an act of treason.

9. The separation of corporation and state being necessary for the independence of a democratic government in serving the needs of the people, no public service shall be under the management of a private sector entity and each State of the United States shall have a state bank collectively forming the Union Reserve Bank of the United States with a state appointed bank official from each State to compose the Union Board of Governors exercising all the responsibilities of the Open Market Committee.

10. Any private business acquiring a national market share large enough to be a detriment to the national economy upon the business' failure shall undergo divestment into smaller units assessed to be economically secure for fallibility in the national economy.
