Read the Rules

Politicians need better rules to follow to prevent lobbying! We tax payers should also fund important elections, so the best person wins and not the one with the most money!!! The movement needs at least these 2 demands!!! Politicians need to be fair and keep it BALANCED for all and not start class warfare! Unlikely but they all need fired so we can start over, but next time they work for everyone and not favor one group over another. Write it down and pass the word!!!

This is what I want first then I want the Politicians to fix it! Plane and simple!

[-] 1 points by The99Amendment (17) 12 years ago

The politicians cannot fix it.

Any law passed on campaign finance reform that limits donations will be struck down as unconstitutional by the Supreme Court as long as corporations are protected as legal "persons".

An amendment to the Constitution is the only way to clearly define a person as a living human being, and not a Corporate Personhood.

[-] 1 points by NintyNiner (93) 12 years ago

Then thats what needs done to make it happen, so be it!!! Amend the Constitution!!!

I'm curious... would this be considered "Unconstitutional" by the same Supreme Court if it were brought up in a suit? I love the idea, and hate that Corporations got away with the biggest power grab since our forefathers decided to cut and run from England or the Bankers got the Fed Reserve act passed.

[-] 1 points by The99Amendment (17) 12 years ago

The Supreme Court is tasked with interpreting the Constitution. Their interpretation is that a corporation is a "person". That is why campaign finance laws are pointless, as the Supreme Court can declare them unconstitutional.

This amendment would change the Constitution. The Supreme Court would have to apply the laws of the land with the amended Constitution that declared that a "person" was a living human being. As such, a corporation could not declare constitutional protection from campaign finance laws passed by Congress.

[-] 1 points by pskrob80 (28) 12 years ago

Then it is exactly what should happen, I applaud the idea. Let me ask further... Now that they are Corporation-Citizens and "People," wouldn't the opposition argue that enacting this amendment would be tantamount to stripping legal citizens of their newly acquired inalienable rights? And thanks for clearing up that last one.

[-] 1 points by The99Amendment (17) 12 years ago

Opposition campaigns would try many tactics and would be well funded.

However, the concept that a corporation is not a "person" is one that I believe would have enough populist support to be enacted, if the information is shared and discussed.

[-] 1 points by pskrob80 (28) 12 years ago

I look forward to seeing if this gains traction.

Since a corporation sustains persons financially, how does this help America?

[-] 1 points by The99Amendment (17) 12 years ago

Corporations would continue to exist. They would continue to do what they do well. Make money for their shareholders.

What this Constitutional amendment would do is simply take them out of the political process. They could not lobby for laws that do nothing for the American people: http://www.reuters.com/article/2011/10/11/usa-tax-repatriation-idUSN1E79A1TN20111011

[-] 1 points by PlasmaStorm (242) 12 years ago

You pose that lobbying does nothing for the American people. I encourage you to read my thread here:

http://occupywallst.org/forum/you-cant-support-free-speech-and-oppose-lobbying/

You say they lobby for laws that do nothing for the American people. What laws do nothing for the American people?

In fact, I'll pose this example. Say a company lobbied for a law, and it was a sole propreitorship and the owner, an American, made $800,000 in income a year, does very well for himself. Say the law helped no one, nobody except the owner. He is an American. Isn't it still his right to lobby the government? Isn't the country better off because he is helped by this legislation?

[-] 1 points by The99Amendment (17) 12 years ago

I suggest you start by reading the proposals at the site the99amendment.com

It is specifically stipulated that corporate offices can contact and work with politicians and government agencies.

I am open to discussing the proposal with you, including feedback on how it could be improved. I am not open to responding to generic "what ifs" presented without first understanding what is discussed.

According to a 2008 article by David Rothkopf, the world’s 1,100 richest people have almost twice the assets of the poorest 2.5 billion (Rothkopf, 2008). Aside from the obvious problem – that this global elite has their hands in everything from politics to financial institutions – …

To the extent that we, the people, are removed from control over our lands, marketplaces, central banks, and media we are no longer empowered. In practice, those few who do control the land, central bank, media and "free market" are the real rulers of our corrupt and declining "democracy."

Due to propaganda from a corporate-owned and edited media we are kept from knowing, much less debating, the nature of our system. Due to a central bank owned by bankers, media owned by a few global concerns, and trade regime controlled by global corporations (i.e., one designed to remove the people from control over their markets and environments) the vast majority have become little more than latter-day serfs and neo-slaves upon a corporate latifundia.

To restore a semblance of effective democracy and true freedom Americans, and people around the world, need to re-educate themselves as to the true nature of their political and economic systems. Toward this end, OligarchyUSA.com is dedicated to providing old and new information, books, links, reform ideas and debates not easily found or accessed today in establishment media.

OligarchyUSA.com is but one more site and sign of the times as ground-up counter-revolutions arise around the world... all in response to a forced and freedomless globalization courtesy of a ruling global elite perfecting their top-down plutocracy and revolutions of the rich against the poor. In short, democracy is no longer effective today. For this reason, it is toward a restoration of truly effective and representative democracies, and natural freedom, that this site is dedicated.

Would you also agree that a labor union is also subject to this same Constitutional Amendment? In general labor unions spend a lot of money annually on political elections. They were design to better the lives of their members at the work place. It is hypocritical to put the two entities in different classes. Neither one is a natural human as the amendment states. I just want to clarify that it would be the case that Labor Unions and Corporations would be treated equally.

[-] 1 points by The99Amendment (17) 12 years ago

Labor unions would inherently be impacted by defining a person (with Constitutional protections) as a living human being.

But your thought sheds light that the amendment may need to be less specific around corporations. Simply clarifying that a natural person only is eligible for Constitutional protection would be enough to allow Congress to pass meaningful campaign finance reform that would pass legal muster.

Thank you for your comment. I hope you join us on Facebook and share.

"We may congratulate ourselves that this cruel war is nearing its end. It has cost a vast amount of treasure and blood. The best blood of the flower of American youth has been freely offered upon our country's altar that the nation might live. It has indeed been a trying hour for the Republic; but I see in the near future a crisis approaching that unnerves me and causes me to tremble for the safety of my country.

As a result of the war, corporations have been enthroned and an era of corruption in high places will follow, and the money power of the country will endeavor to prolong its reign by working upon the prejudices of the people until all wealth is aggregated in a few hands and the Republic is destroyed. I feel at this moment more anxiety than ever before, even in the midst of war. God grant that my suspicions may prove groundless."
