General Services Administration – with the Blessing of the Obama White House – Tells Law Enforcement to “Stand Down” and Not Enforce the Law Against Occupy Protestors According to Records Uncovered by Judicial Watch August 07, 2012

(Washington, DC) – Judicial Watch announced today that it has obtained records from the Department of Homeland Security (DHS) indicating that the General Services Administration (GSA), with the blessing of the Obama White House, instructed law enforcement officers to “stand down” and not arrest “Occupy Portland” protestors who were in violation of the law.

The records, obtained pursuant to a November 11, 2011, Freedom of Information Act (FOIA) request, include internal DHS correspondence. One November 6, 2011, e-mail exchange between DHS/National Protection and Programs Directorate Chief of Staff Caitlin Durkovich and GSA Public Buildings Service Commissioner Robert Peck (who has since been fired) specifically related to Occupy Portland protests taking place on federal property in Portland:

I am sorry to be emailing you on a Sunday night, but wanted to let you know our Press Shop has received a couple of calls from Portland media outlets about a group of 11 protesters who again set up camp at Terry Shrunk Plaza in Portland last night. They have chained themselves to a large drum filled with concrete. GSA controls the permits and has asked FPS [Federal Protective Services] not to enforce the curfew at park and the prohibition on overnight encampments. Reporters have asked if we will be arresting the protestors as FPS did last week.

Our FPS Commander in Portland says they are standing down and following GSA’s request to only intervene if there is a threat to public safety.

Peck responds:

Caitlin: yes, that is our position; it’s been vetted with our Administrator and Michael Robertson, our chief of staff, and we have communicated with the WH [White House], which has afforded us the discretion to fashion our approach to Occupy issues…The arrests last week were carried out despite our request that the protesters be allowed to remain and to camp overnight…

Occupy Portland is part of the Occupy Wall Street movement, which has been beset with accusations of “crimes and dangerous behavior” during its protests.

According to the Oregonian, the week before this email exchange, on October 30, 2011, “Twenty-five Occupy Portland demonstrators were arrested…after refusing to leave Jamison Square. The arrests capped an intense hours-long standoff between police and dozens of protesters who refused to leave the Pearl District park after it was declared closed at midnight. Officers, some in riot gear and others on horses, faced off with protesters who remained in the square, despite being ordered to leave.” The protestors were reportedly arrested on accusations of “trespassing, interfering with a police officer and disorderly conduct for the noise complaints from neighbors.”

Robert Peck was at the center of a scandal involving the GSA in 2010, where the agency spent $823,000 on a lavish Las Vegas “training conference” that featured a clown, a mind reader and a $31,208 reception. Peck was fired as a result of the incident. Peck, who has donated thousands of dollars to Democrat candidates, including Barack Obama, was previously implicated in an unrelated GSA scandal for reportedly brokering a controversial lease deal for a Democratic donor and friend of former Vice President Al Gore. Per The Washington Examiner’s Mark Tapscott: “In Peck’s first go-round at GSA, controversy was sparked when it was learned that excessively high rent was being paid by the FCC to the owner of a building who also happened to be a Democratic donor. Peck was the official who made the deal possible.”

Peck was deposed by Judicial Watch today in a separate lawsuit on behalf of Linda Shenwick, a GSA whistleblower who Peck and others allegedly retaliated against because of Ms. Shenwick’s opposition to wasteful spending, such as parties, that have now caused so much controversy.

“We now have a new GSA scandal – one that involves the Obama White House,” said Judicial Watch President Tom Fitton. “These documents clearly show that federal agencies colluded with the Obama White House to allow the Occupy Wall Street protestors to violate the law with impunity. These documents tell us that the GSA and DHS can’t be relied upon to protect federal workers or property.”

I am against killing people without trial outside of war. As such I am against the drone attacks.

I accept the massive reduction of military killings as proof the Pres is working toward the end of that civil rights violation.

I think that is a major part of our disagreement. As well as my contention you never put the blame where it belongs with the republicans who created and ramped up all these crimes. Instead you blame the guy who has reduced the use.

This is a good thing for Occupy, seize this window of opportunity. I think Obama is doing this for his own political game, it's populism. In an election season, he's harnessing the power of the wind. It's a clear strategy against Romney, and exactly what I would do in his position. Well played Mr. Obama, well played..

Beware though, as soon as the political advantages and expediency have worn off for his campaign, the protection will go away as well. Like I said, this is a window of opportunity, but the media will do it's best to distort the message to their own ends.

Of course I think the same of the other party. To see someone like McCain who served as a combat officer in the Navy, was tortured and a POW, to turn treason on the American people with the NDAA. It's absolutely sick. The Neocons are pure evil and have been worse as far as body count, the Iraq war, and the setup of the Patriot act. At least the dems used to seem to have good intentions, but now there aren't hardly on either side that will stand up for civil liberties. Things need to change quick and substantially, or we'll end up in a civil war. That's why occupy is so important. This may be our last chance.

I'm with Kaiserw on this one, it's an election season, so expect to hear some fluff... I mean, Obama had many many opportunities to enact regulations on wall street, to make any kind of serious change in the game they are playing. He gave them golden parachutes and made minor changes that have already begun to expire...

Whatever push OWS makes to regulate wall street, to get electoral reform, to pass liberal agendas, it can't just be a free ride! Put their feet to the fire!

One great group is the new progressive alliance (newprogs.com I think) and they have a unified platform fairly similar to ones you'd see at OWS or green party and such, and they are getting candidates to endorse the platform openly. OWS can help them, or do similar such work, make a unified platform, some important key elements (electoral reform, lobbying reform, wall street regulation) and spend the rest of the election trying to get people to publicly endorse it and stick to it. Seems the most logical to me anyway, and you can publicly endorse greens and ds, so long as they are progressive enough.

I am now certain that VQ is posing as an Occupy supporter in order to set a partisan narrative that Occupy is a democratic party movement. Not by individual conversion but by flooding this forum with material that would leave visitors with such an impression.

In this article that has no links or citations, states that the White House gave the power of discretion to GSA but VQ has equated this to support, which is not based on fact.

VQ has been asked time and time again to refrain from partisan baiting yet refuses to do so. If VQ actually believed Occupy was beneficial to the Democratic party, VQ would be doing what all other Dems are doing, that is to seduce independents and undecideds. VQ and everyone on this forum knows, that can not be done with relentless partisan attacks.

The evidence that VQ is a subversive is staring this forum right in the face.

This is ridiculous. I am a soldier fighting for the poor for all my 49 years. OWS is a progressive movement I have lent my body and support to many actions in the last 10 months. OWS is not partisan. I am partisan. I am anti republican partisan. I make no bones about it.

Rocky is a good man, I'll still vote Green, but there absolutely needs to be a stand for Electoral Reform, which is the only thing that could end the two party duopoly. If groups start building up steam, the key will be in unifying different dissenting groups into a cohesive argument of "'we demand better representation"

Fairvote.org has lots of good information, and groups like the New Progressives Alliance make it a crucial part of their campaign. I feel like I'm slamming my head against a brick wall trying to talk to Tea Partiers or Occupiers about making it the central goal. To me, it seems the only way to stop the two party duopoly, and I know that all the other presidential candidates would agree....

Absolutetly whole country needs to facilitate for more parties and voices to get access to state ballots.

Here in WA state, libertarians sued to get Romney off the ballot, but were not successful

It's a tricky thing getting elected in America. OWS certainly is representative of the base but so much of the country has moved right for 30 years you have to present yourself as tough on crime, tough on military, not for helping the poor. (Obama rarely if ever SAYS poor). Because he CAN'T if he wants to get elected. So much of the country is just selfish heartless people. Maybe if we repealed the elctoral college we might get a better representation of what all people feel and not have to cater to the people in the big empty states.

You think I come here for popularity? Maybe that's why you do, but I am here :

  • To support positive solutions that can improve the lives of the 99%

  • To challenge the fallacy that the "parties are the same" they Ain't!

  • To challenge unfair attacks on the Dems who are our natural supporters, and who stand against the natural supporters of the 1% plutocrats. (enemy of my enemy is my friend)

  • To convince all reasonable people that repub/conservative policies are at the root of all our problems.

I'm not pretending I am anything else. I support the efforts to create a new system, from the ground up, horizontal, which includes real direct democracy. I've recommended an experimental dry run. No takers.

When it emerges (& I'm sure the non partisan anarchists are working feverishly on it) I will be there to support it. I support OWS in many ways, 1st and foremost with my body on the front line, in the street!

So think what you will. I will assume in fact you speak for only you and I will dismiss your opinion as irrelevant to all these much more important issues.

My advise is to focus less on calling me names (hack) in an effort to silence me. And focus on positive solutions you think might improve the lives of the 99%.

I haven't called you names, I find you to be quite genuine. I admitted that the other guy was unsubstantiated in his anti Obama claim, and I've seen others referring to you as too hard on the party-line. But you're very honest about it.

I wrote in another post in response to Ds or Greens in the election, and honestly it's something that ows should really be on both sides of..., But I like the new progressive alliance approach, www.newprogs.com I think, and tha'ts to make a unified platform, get as many candidates of any party to endorse it as possible, and push it non-stop until the election. Either you get more progressive Ds, you get Greens, or you've at least moved the middle ground, the range of debate, a little to the left.

I like that concept a lot. It is based on policies/ideas. And maybe It can be a mechanism to get pols "on the record". It can be used to protest against particular pols who refuse, or agree then renege. The reality is that real change will take years and hard work.
