Forum Post: Obamacare Killed by Supreme Court Decision

In its 5-4 decision, the Supreme Court ruled that the “individual mandate” could be upheld ONLY if it is established as a congressionally-authorized “TAX.”
President Obama has solemnly and repeatedly pledged that he will in no way raise taxes on the working class, i.e. the 99%. “I can make a firm pledge – under my plan, no family making less that $250,000 a year will see any form of tax increase.”

A significant portion of the $1.7 trillion dollar tax increase intended to fund Obamacare would fall of people who earn just above the poverty level of $11,800 per individual/ $24,000 for a family of four.

Does this administration really believe we are so stupid that we can be bribed, with our own money?

the tax cuts are not going to be extended. look forwward to paying thousands more in taxes starting jan, 2013

Not for the wealthy or corporations. They were supposed to end in 2010, but the D's extended them for 2 more yrs, in exchange for a 1 yr extension of unemployment benefits.

if you make about 50,000 , your taxes will go up about 2-3000 , if the bush taxes cuts are not extended.

They don't believe it, they know it. The "gimme gimme's" will vote for whoever offers them the most and this is just another way to lock up the ignorant and lazy vote (a demographic that expands each generation).

well I wouldn't call it dead yet frankly I'm not sure why you would call it dead when the supreme court upheld it. However the absurdity of the ruling wasn't the commerce clause but the tax clause which might kill it if congress did an end run around it to define what a tax is.

There are two types of takes that I know of one is some kind income tax estate tax property tax etc. etc. The other type of tax is a sales purchasing tax.

What roberts is suggesting is this is a tax for not purchasing something. I would call that a fee or penalty payment not a tax. If it was in fact a tax then it would be a one of a kind NON-sales tax. Thank you roberts can I have some of your stock in insurance companies

Obama would have to break his pledge not to raise taxes on the working class to implement Obamacare in its current form, The tax burden on those just above the poverty level would be intolerable.

Great to call it TAX! - the GOP should pick up un that and make it a single payer system paid by the so called Health Care tax!

That would reduce the healthcare cost by a lot.

the SCOTUS "tax" definition refers to the PENALTY for not buying insurance -
not the mandate or the insurance

There is no greater threat to the future of America than its reproductive health - an undeniably true statement - and in accordance with precedent, henceforth and forever more, it is hereby decreed ye shall all be "taxed" (what?) for the inactivity of the willful failure to engage in such reproductive acts...

And yes this IS a very apt analogy.

And if you think we have a Constitution in this country you're an absolute fool; nor do we have any need of a Supreme Court to decide this nonexistent Constitution, especially in light of the life term - why not simply flush them with every new presidency, the results would be exactly the same.

This is what happens when the Chief Justice of the Supreme Court decides to rewrite legislation from the bench after he promises not to be an activist judge. Whether Roberts is a liar or an idiot or both, the result is the same. He decided the penalty for not buying health insurance is a tax, even though every politician who voted for ObamaCare, including the president, said it was anything but a tax. This makes the whole process leading to ObamaCare and the process of judging the constitutionality of ObamaCare dishonest and corrupt.
