IN THE HOUSE OF REPRESENTATIVES March 7, 2012

Mr. JONES submitted the following concurrent resolution; which was referred to the Committee on the Judiciary

CONCURRENT RESOLUTION Expressing the sense of Congress that the use of offensive military force by a President without prior and clear authorization of an Act of Congress constitutes an impeachable high crime and misdemeanor under article II, section 4 of the Constitution.

Whereas the cornerstone of the Republic is honoring Congress's exclusive power to declare war under article I, section 8, clause 11 of the Constitution: Now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That it is the sense of Congress that, except in response to an actual or imminent attack against the territory of the United States, the use of offensive military force by a President without prior and clear authorization of an Act of Congress violates Congress's exclusive power to declare war under article I, section 8, clause 11 of the Constitution and therefore constitutes an impeachable high crime and misdemeanor under article II, section 4 of the Constitution.

Stop bombing nations that did not attack us. There are innocent civilians in those cities where our government is dropping bombs. It's ridiculous that our government is still attacking nations that were no threat to us and did not attack us even after the warmonger Bush administration.

I'll start taking this seriously as soon as Bush, Cheney and Rumsfeld are turned over to the International Criminal Tribunal in the Hague.

Shouldn't you take all war crimes seriously always?

I get it. Bush committed war crimes. And he should be punished. But please don't dismiss current war crimes under the current president because Bush has not been punished.

Both need to be punished.

And here's a great question... Why didn't the democrats in congress try and impeach Bush? Why did they wait until 2008 at the end of his 2nd term? I'm calling cahoots. And that impeachment bill was from Dennis Kucinich who is considered a renegade in comparison to the rest of the democrats... and a personal role model of mine. But even I was shocked to see how long it took him.

Both parties work for war and for the 1%.

Why is Obama's administration covering up torture evidence from the Bush administration?

There's a lot more going on here than meets the eye.

Well, it really is a Gordian Knot. I mean, if we attack this president for war crimes it could harm him enough to allow an even worse criminal to become president. I plead confusion. Bush lied us into a war and who know what other connections he had to the 911 incident. Obama sends Robot Drones to terminate terror suspects. Really, they are both guilty, but I can't bring myself to assist the Republicans in replacing Obama with one of their neocon monsters.

Here Here! In the mean time it just looks like a furtherance of the slow motion Coup de' Tat! It's funny how foreigners can see this clearly when we can't. In 2010 we handed Obama a hostile Congress, Supreme Court, and the whole corporate oligarchy to deal with. He is not a king. He must have some additional power to support him, or he really can have limited effect upon the nation's agenda! That's a FACT. And yet all the trolls here keep pointing to Obama, as if he were responsible for this mess!

Bush and Blair have acually been convicted of war crimes, yesterday, by a war crimes tribunal in Malasia. They can no longer travel overseas without fear of prosecution. Was this the impetus of this post, to distract and try to nullify the current facts?

Please don't equate people like me to "tea baggers."

War crimes are war crimes. End the wars. Stop supporting people that bomb nations that did not attack us.

It's funny the way you partisan people work. During the Bush era I called him a warmonger and the republicans called me a "crazy unpatriotic liberal." Now when I call Obama a warmonger the democrats call me a "GOP supporter" or equate me to a "tea bagger." Back in the 60's and 70's my anti-war mantra would have been equated to the "hippies."

I do not support anyone guilty of war crimes. I do not support anyone that bombs nations that did not attack us. I do not support war monger presidents. Warmonger presidents need to be impeached when they're republicans and they need to be impeached when they're democrats too.

Don't get stuck in this democrats v republicans crap. It's a divide and conquer technique. BOTH PARTIES WORK FOR THE 1% and FOR WAR. One party, the republicans, are much more obvious about it... I'll give you that.

Good question. I'm pretty sure there were several. They didn't make it past the committee level due to bullshit corruption. Believe me, I supported impeaching Bush for war crimes.

War crimes are war crimes. All guilty must be brought to justice. I'm sick of warmonger presidents bombing nations that did not attack us. It was not okay during Bush and it is not okay now.

Why didn't the democrats pursue impeaching Bush? Seriously? That's an even better question. My favorite politican Dennis Kucinich did, but he waited until 2008 for some reason.

I can't believe they backhanded the constitution, saying they didn't need congressional approval because they had "international permission" for the attack on Libya. There is no such thing. Absolute treason. http://drinkyourkoolaid.com/panetta-says-international-permission-trumps-the-constitution/ (this seems to be a hyper-conservative website - oh, well).

Note that Joint Chief Gen. Dempsey said the same thing - unbelievable. Red states have always worshiped the military. Gen. Dempsey just punched a gaping whole through his own lines.

Don't forget about the War Powers Resolution as well as international treaties signed after WWI and WWII that make just about most military operations and wars our government has been involved in since the post WWII era illegal.

I don't disagree with you, but there's a political problem here. The message, 'same as it ever was' is automatically disempowering. It causes the 'oh well, and throw up one's hands' response.

To motivate and reach out I believe we need to stress what is new and different in outrages such as this. Always before some funding proposal or some open-ended statement has been sought from congress. Here Obama and the military didn't even bother with a fig leaf.

in comparison to Clinton and Bush - Obama looks relatively soft about war crimes. it is probably lemon press which conduct invisible bills against president. Dont forget that Obama has 50/50 chance to lose, like in lottery - you never know if you win or lose, but the "chance" remain 50/50 =)

This is a solid bill. The bill itself is not a party preference bill either. A republican president would be held to these standards as well. Or until they find a way around it like they did with the War Powers resolution. No president of any party affiliation should be allowed to bomb countries that did not attack us. It's terrible foreign policy and it opens up our nations to war and attacks.

Sadly the guy who filed it is a republican dick, congressman Walter Jones... this just happens to be one thing I agree with him on.
