Forum Post: AP leak - my understanding of the truth - from Chris Hayes

In May 2012, a British agent discovered a bomb plot in Yemen to blow up an American plane. Although the plot was stopped, the AP got the story via a leak. Co-operating with our government, the AP agreed to not publish it while Justice were investigating it.
AP discovered that Justice was going to release the story on a certain day – and decided to release the story a day early.
When this story was released by the AP, numerous senior republicans ranted and raved about how could Obama let this leak happen and demanded an investigation.
Holder initiated a very substantial and legal investigation. The rules require that the press, if investigated, must be pre-notified so they can appeal to a judge to stop it – unless national security is at stake. It seems that a leak about an imbedded British double agent’s identity is that serious.
Because Holder understood that the investigation could lead to his testifying, he recused himself and turned over the investigation to an assistant who made the decisions.
The Justice Department was not taping calls – it subpoenaed AP phone logs to try to find out how the info was leaked about this operation got to who in the AP.
